Complaint Details
The complaint against ShopClues.com is as under:
a) I have paid Rs:29,892/- through online for Dell Laptop E6420 Core
i5 16GB RAM 1000GB HDD Windows7 professional 1tb latitude Code:
84426876 product Vide order No: 93539399.
b) I have been receipt of the Dell Laptop E5420 laptop which has not
been order instead of Dell Laptop E6420 and the same have been noticed
to the company on 28 June 2016.
c) The Dell laptop E5420, which have sent to me was 2011 manufacturer
old Dell Laptop E5420 model instead of E6420.(This is called Cheating
with the consumer)
d) The warranty for the product have been given to Dell laptop E5420
old 2011 model as Seller warranty i.e. one month as per bill/invoice
received to me.
e) The same has been complaint to the shopclues by phone as well as
by email on 28 June 2016 with your system Return Number: 2925133.
f) No action on the said matter have been taken after repeated phone
calls and email by your company.
g) The laptop was stoped working and same was noticed to the company on 11 July
2016 by email.
h) After repeated request on phone calls as well as several emails
reverse pick up for laptop email have been received on 31 July 2016.
i) On 06 August 2016 the Dell Laptop E5420 old 2011 Model have been
pick up by the company.
j) After repeated reminders and emails, due to non receipt of the
laptop since 06 August 2016 to 25 August 2016 from the company, the
same has been noticed to the company by email dated 25 August 2016
that the old 2011 second had dell laptop E5420 is not acceptable and
refund for the same may please be given.
k) After receipt of my 25 Aug 2016 email, the company have send me email on
30 Aug 2016 your product will be will be delivered to you within 5-7
Business Days.
l) The same have been refuse to take the old 2011 Second hand Dell
laptop and again requested for refund of the money.
m) Till date lot of emails as well as phone calls have been reminded
for refund of the money for such type of cheating with the customer by
company.
n) Every time the company service personals / providers are
requested on phone calls to us for give the company 24, 48, 72 hours
for resolution for the same.
o) Several phone calls have been called for the said matter (may be
amount of phone calls is more than 1000 rupees and the wastage of time
also).
p) On 28 Oct 2016 the company email stated that "Based on your request, we
would like to inform you that we are unable to provide refund for the
product in brand warranty and case is approved for replacement/repair
so kindly confirm us with same from that we can reship the product."
q) On 29 Oct 2016 I have requested for replacement of the product of
"New Dell Inspiration 15N3542 core i3 4th generation 8gb ram 1TB HDD
Window 8.1 warranty, Product ID 85051075" instead of old 2011 Dell
laptop E5420 due to your company is unable to provide refund.
r) Till the company neither providing me refund of my money as well
as instead of selling old product to the consumer in the name of
refurbished product.
s) Under the Consumer protection Act the company are hiding the information
of the product to the consumer and under the name of refurbished
product you are selling second had 2011 old product on 2016 as well as
sending wrong product to the consumer by way of cheating.
t) Now the company stated that the product was under "Brand Warranty" and
due to the same it was not refundable.
In view of the above I state as under:
i) The Product which company has sent to me was not under Brand warranty,
it was under seller warranty under refurbished product and the warranty was for only one month.
ii) The intention of the company to the consumer is cheating to the
customer and looting of money from the customer.
Only harresment is going on by the customer support team.
I hereby request you to kindly refund may please be provided through the company.
