We had placed an order for interiors in our apartment with customfurnish.com. Final designs were finalised on 16.01.2017. Though they had promised delivery within 30 days as per their estimate, due to non-availability of hardware I had relaxed this deadline. However there was little progress at the end of two months, that too after repeated phone calls and emails. Finally on 22.03.2017 their representative Mr. Venkateswarlu agreed to the penalty clause of Rs.10000 per day if the final schedule was not met. Needless to say they missed these deadlines as well. When the final amount was to be settled, they are going back on the penalty amount and asking me to pay the entire amount owed to them. Inspite of talking to high level management including their CEO they are adamant that penalty cannot be imposed and that I had to pay the entire amount.

Their website states - "Our processes are enabled to ensure quality is as promised, transparency in pricing, order fulfillment and project execution as per committed timelines.

As per not committing to deadlines, I had imposed a paltry penalty of only Rs.40000 and had sent an email at each instance of imposing the penalty. When calculated actually the penalty amount would have been more than 1 lakh.
As on date, even after three months, there are still some issues pending which they are willing to do but without a penalty and without any deadline.

Because of their delay, we had to postpone our house warming ceremony three times and pay rent for three additional months which was the primary reason for imposing the penalty.

As against the full estimate of Rs.990661, we had paid Rs. 894422 with a balance of Rs.96239. We are ready to pay the balance amount of Rs.56239 for the bed and sidetables after deducting the penalty of Rs.40000. But they are not willing to give us the bed and accept the penalty.

I feel cheated that they agreed to the penalty amount in email and not honoring it. Is this not cheating? You promise something and dont abide by it.
