Subject – Consumer Complaint against M/s. IIT-ian's PACE Education Pvt. Ltd
Dear Sir/Madam,
With reference to the subject complaint, the narratives are as under.
Background of Sufferer
My cousin, Mr. Rahul Patel along with his joint family, is residing in Malegaon and has small scale family business. He has a daughter (studying in 5th) and a son, master Neel Patel, passed 10th last year i.e. March 2016.
To ensure his son’s bright future, he thought of admitting him in PACE-Mumbai, a well-known reputed coaching institute for 11th and 12th standard preparation for JEE mains and advance. As Master Neel was nurtured in joint family and not left home in past, he was a bit resistant to go out for study. Somehow, my cousin convinced his son to take admission in PACE – Mumbai. I, under signed, Harshil Patel, residing in Mulund (w), Mumbai for approx. last 10 years.
Narration of series of incident
On 25th Sep 2016, we along with Neel and his parents (came specially for the purpose from Malegaon) visited PACE – Thane to get information about the admission process. After that on next Sunday i.e. 23rd Oct 2016, we visited PACE Thane again (Neel & his parents came specially for the purpose from Malegaon) and requested for trial of lectures for 2-3 days. PACE agreed for trial, however, PACE asked for advance to be paid at-least Rs. 50,000/- as we were already late for admission. As my cousin was worried about his son’s admission and hence, his education, he immediately handed over Rs. 50,000/- cheque (Cheque no 150255) to PACE, which was encashed by PACE.
After 2-3 days trial, master Neel Patel, went back to Malegaon for Diwali without discussing anything with undersigned and didn’t agree to come back for studying in PACE, as he was a bit bogged down by the competition and load of preparing for the past lectures along with keeping pace with the ongoing course. He was facing all these first time in his life.
Immediately, the undersigned, personally went to PACE on next Sunday ie. 13th Nov 2016 and requested for refund of 50,000/-. The PACE representative requested to undersigned to send a written request. Immediately on the same day, undersigned forwarded a written request for refund to PACE.
Continuous follow up for refund
Since, then I contacted about 4 PACE representatives as directed by respective representatives. Some of the follow-ups are as given in the attachments. A series of telephone call also made to each represnetatve as directed by previous representative. Every representative was saying your application is under progress and will be approved.
Upon asking in last week of March17, Ms. Chandani, working in Andheri office, mentioned that your application is approved and it is in accounts for further process. She mentioned, due to heavy workload of year ending it is delayed and will be processed as soon as their yearend workload reduced. It is worth to note here that there was no response from PACE against our written mail, whatsapp message or telephone. Lastly in May17, when I called for the follow-up, Ms. Kawaljit, senior executive of PACE, said it has been too late to refund. So much of time passed. After these statements she didn’t wanted to listen any request and just asking she cannot do anything. Undersigned requested a lot and also asked if he can meet or call higher authorities but she was stuck to only one frustrating answer that she cannot do anything.
Undersigned also mentioned that he will not have any avenue left other than registering a case against PACE in Council for Fair Business Practices (CFBP), but she refused to listen and gave the same answer that she cannot do anything.
Importance Acknowledgement of back ground of sufferer
We must appreciate that master Neel was first time come out of the comfort zone of his family and could not manage to stay away from family with the pressure of study. On the other part, a aspired father is there, who don’t want to miss the opportunity to take admission in a reputed academy like PACE and hence paid Rs. 50,000/- as an advance.
A request to CFBP
My submission here is that even after talking to Ms. Kawal Gupta in March 2017, she didn’t mentioned that its not possible to refund the money. I had word with her subordinate Ms. Chandani, in March and April 2017. She mentioned that our refund passed and its with accounts department for payment. Suddenly in last call in 13th May17, Ms. Chandani and Ms. Kawal Gupta mentions that ITS TOO LATE TO REFUND AND NOW NOTHING CAN BE DONE.
With folded hand, we request you to help us to get refund of our Rs. 50,000/- as soon as possible. It will pass on right message to PACE kind of institutions to set their processes right and enhance customers confidence on CFBP.
