My husband Ritesh and I, Vigneshwari travelling in a Uber on 13th Feb 2017 morning around 6:10 AM from Mumbai domestic airport to Borivali station. Grievous accident happened around 6:45 AM near Carnival Cinemas on the flyover where my wife was thrown out of the car to the middle of the road as the Wagon R (MH 02 EH 3615) toppled multiple times. I was stuck inside the car and had to break the back window to get out. My wife was thrown out of the car through the side window whereas the door was closed still. She fell on the middle of the road and had to crawl to the divider to save herself from the vehicles coming behind her. The driver fled the spot as soon as possible, as he wasn't injured. After this traumatic incident, my wife suffers multiple injuries including bruises on face , hands, dental fracture, multiple spine fractures in her lumbar and thoracic region. She was admitted to the hospital for a week and now has been kept on bed rest for next 3 months. Her work and career suffers a great deal because of this incident. Expecting a corresponding action in this regard.

Uber customer care executive(Balaji) on the day of the incident said off the record that the driver sped at 110kmph when the incident occured. The driver had driven till 11PM the previous day (12Feb 2017) and then started taking trips from 4AM on 13 Feb 2017 giving only 5 hours gap. This led to the driver sleeping on wheels while driving and leading to car toppling to avoid collision on a truck which we had to point to the sleepy driver.
Now Uber doesn't care apart from suspending the driver and refunding the trip fare. What is their responsibility in this regard?
FIR has been registered against the driver in Kasturba Marg Police station , Borivali East, Mumbai. FIR NO: 19378059170101 UNDER SECTIONS 279,338.
