Complaint Details
I Satish Upganlawar age 52 years resident of G 1304 Maple heights Sushant Lok 1 Block C Gurgaon 122009.
1 I bought Honda Civic V A/T HR 26 BL 4970 year of manufacture 2012 from Mahindra first Choice Wheels MG Road Gurgaon. When car was sold to me I was given in writing following (copy of letter dated 30th Aug 2013 attached exhibit 1).
a) Above mentioned car non accidental
b) Car is running under valid warranty till 2015
c) Non meter tempered
I was also provided with letter dated 30th Aug 2013 (copy of letter attached as exhibit 2) mentioning following.
a) Any three penal to be painted
b) Rear bumper to be fixed(I had brought before company about damage to bumper)
c) Front – left side mud flap-new to be fixed
d) Dry-cleaning plus Teflon coating after six months
Very next day I found car’s rear sensor not working I took car back to Mahindra First Choice MG Road Gurgaon. I was assured that car is under warranty as such it will be replaced
Car was kept at M/s Parl Honda for rear sensor on bumper replacement, car was kept for 15 days latter pearl Honda told me I have to pay for bumper sensor as it was accidental damage(copy of email from Honda Motors attached exhibit 3). I was also in formed by Honda Motors that car is not under warranty as car is not serviced as per Honda terms and condition
I contacted Mahindra First Choice I was informed by Mahindra First choice will replace bumper sensor FOC (copy of letter attached dated 19th Dec 2013 Exhibit 4) in same mail it is also mentioned car is under OEM warranty and if Honda denies Mahindra First Choice will honour for one year from date of purchase .
I refused to accept Mahindra First Choice offer on following grounds
a) Why should I accept accidental car
b) Why should accept car which is not under warranty from Honda for 2.5 years
I request Hon Court to direct Mahindra first Choice to refund my money with interest and also pay damages in following manner.

Filed case in Sheikh Sarai Consumer Forum New Delhi Dec 2014. My final argument completed April 2017 but till date Mahindra Lawyer dont turn up however consumer forum not passing exparte order also
