I am not receiving any response from Registrar Office even after sending reminder through registered post.
The contents of letter (copy attached) sent to Registrar office is as under:
Please refer Clause No. 3 of attached FAQ’s wherein it is stated as under:
Member ‘A’ stays on upper floor he has not done any type of repairing or changes in his flat, even then the leakage develop in the flat of member ‘B’ residing below ‘A’ then can the cost incur on it made from the funds of the society?
Under bye laws it is obligator to incur such cost by the A and B togetherly. The society cost as per the resolution of general body meeting.
I would like to state as under:
There is water slippage from washroom/s of A-306 to my apartment (A-206). The owner of A-306 wants me to share the expenses incurred for plumbing (Approx.Rs.3,000/-) of his washroom/s referring the Bye-laws. As a Citizen I have agreed to share the expenses equally.
But…
I have to carry out the repairing work such as painting (approx.. Rs.5,000/-) and electrical work (Approx. Rs.1,000/-) of my damaged master bed room and its surrounding area because of water slippage from upper floor (Apartment No. A-306) for more than a month’s period. The water slippage is personal seen by the members of Managing Committee of Eleganta CHS
The owner of A-306 is not all ready to share the expenses (totaling Approx. Rs.6,000/-) for repairing of my apartment taking the advantage of Bye-laws which is HIGHLY INJUSTICE to me.
Hence requesting yourself to give a decision as who will have to bear the expenses in my case.
