I (Satish Chand Garg) have purchased Maruti Baleno Delta Petrol car on dated 12.07.2017 from Fortune Cars (A Unit of Jyoti Automobiles Pvt. Ltd.) Alwar vide their Invoice No. 001/VSL/17000005 dated 12.07.2017 having Vehicle Registration No. RJ05CB 1540, Vehicle Chassis No. MBHEWB22SHF137863 and Engine No. K12MN7116001 and it is covered under 3rd and 4th year extended warrantee vide their Invoice No. EW26560 dated 19.07.2017.
Recently, this vehicle has met with an accident and the front left side of the vehicle have fully damaged. I have also noted that front side Chassis also got badly damaged. However, safety airbags have not opened in this sever accident.
I have taken up the matter with the company, but the concerned person of the company has not given any satisfactory reply. The company has taken the stand that the collision has been on the side of the vehicle because of which damage has been occurred. The concerned person of the company replied that the air bags are not designed to activate in rear impacts, side impacts, roll-overs, or minor frontal collisions.
We strongly not agreed with company replies given in their emails in regards to safety features provided by the manufacture and its operations on the following grounds:
1. The vehicle has been majorly damaged/impacted during the accident from left front portion.
2. The functioning of the air bags in such accident is warranted as it’s the main safety feature.
3. Non-opening of the air bags in this accident seems a failure in the safety system.
4. As company refer to the Supplement Restraint System “Air Bag” enumerated in the Owner’s Manual & Service Booklet provide by the dealer at the time of sale.
5. Our car has been badly damaged on left front side and even its chassis has been got damaged badly. Thus our case is not fall under the exclusion causes pointed out by the company. In my case, the accident impact was so severe that the air bags needs to be opened up. It was a clear cut case of failure of safety feature as claimed by the manufacturer.

In the car’s “owner’s manual & service booklet” the air bag censor has been shown on right side only as per booklet page no. 2-42. There is no air bag censor in front as well as left side. Thus accident from left side, whether sever or not, the air bag shall not open. So the installation of the airbag in left side shall have no meaning in regards to safety. In this situation it seems that the air bag installation and safety ad given by the company is just a sham and practically safety is not there in their cars.
I have written email dated 05.10.2019, 11.11.2019, 19.11.2019, 28.11.2019, 07.12.2019, and 16.12.2019 and specifically raise the issue of air bag not opened in case of sever damaged of chassis. However, the concerned person of the company has not replied on this.
So, matter has now been taken with your department with attachment of email sent and reply received.
