Respected Sir/ Mam,

I Mr. Arpan Roy, a Merchant Navy candidate, resident of Indira Nagar, Nashik would like to bring to your notice that I have paid Rs. 50000/- (Rupees fifty thousand) as course booking amount to Mumbai Maritime Training Institute (Address: 41/B, New Excel House, Azad Nagar Road, No.2, Off Veera Desai Rd, behind ICICI Bank, Andheri West, Mumbai, Maharashtra 400053), Andheri, Mumbai (for UK 2nd mate COC ( a Merchant Navy Competency course) course for February 2020 batch) on 28/03/2019 (vide NEFT Transaction No : KKBKH19088728763 ) (transaction receipt attached along with), but as I was not able to arrange for the requisite course fee I was not able to enroll for the course in February 2020 and therefore I asked for a refund of the course booking amount from the institute (emails requesting for refund attached along with). But upon my request the institute denied to pay me any refund and told me that the booking amount is not refundable.

So, after trying a lot I was able to arrange for the requisite course fee in March 2020 and requested the institute to enroll me in the ongoing February batch.

But the institute didn’t enroll me (and didn't even bother to respond) and after that the institute was also closed due to Covid-19.

So, I had to return back the entire amount along with interest to the people from whom I have borrowed the amount.

While dealing with my case please note:-

1. The institute was informed well in advance regarding my financial situation (that I am going through a financial crisis) and a refund request was made almost about a month before the scheduled batch. And the amount paid is quite a heavy amount for me.

2. The principal college (Fleetwood Nautical College, UK) with whom the MMTI, Mumbai had a tie up to conduct the mentioned course don’t have any information regarding the particular February 2020 batch on their website (screenshot of the same has been attached), although they have the dates of previous year’s (2019) batches and the dates upcoming batches mentioned on their website.

3. Thus the conduct of February 2020 batch of the mentioned course in MMTI, Mumbai should be subject to verification as it is quite likely that the institute was not in a position to continue to conduct the course due to Covid-19 and Govt. imposed lockdown for the mentioned batch. And if the batch itself has been cancelled or delayed or merged with any upcoming batches then institute should not hold back the money blaming the student for not enrolling in a batch which does not exist and should issue the refund.

4. The amount that I have paid was the course booking amount and not the fees against which I have been provided any service by the institute. So as they have not provided me any service (no enrollment, no admission, no teaching) against the amount which I have paid so they should provide a refund.

5. Lastly and the most important part is that the institute had not informed me about their personal non refundable policy before the money was paid and neither did I sign any written agreement physically or digitally with the institute approving them regarding the same. (The payment was made by me via NEFT transaction from Nashik and the institute confirmed the receipt of the amount via an email from Mumbai). So this is very much against any fair business practice.



Now as I was not enrolled and due to prolonged lockdown amidst the Covid -19 crisis, adding whole lot of financial stress and trouble to my family I am not in a position to enroll for the course now or in near future and I am also not in a position to throw away my hard earned money which I paid as a course booking amount (Rs. 50000/-) under any circumstances in this crisis situation.

So Sir, it is my earnest request to you, and me and my family will be very thankful to you if you can kindly help me in getting the refund of Rs.50000/- from MMTI Mumbai.
