Complaint Details
I have a grievance to make. I am one among the 1000 eligible winners of the Android- KITKAT NEXUS 7 contest here in India. This contest was promoted by Nestle India to mark the alleged collaboration of multinational corporates namely Google and Nestle, in launching Google's latest Android Operating System named KITKAT (also name of Nestle's chocolate). The original contest started in the USA on September 6,2013. Winners were promised through promo ads/Infographics/posters etc that winners would be "among the first 1000 people in India" to win "the all new exclusive Nexus 7 (2013) tablet". Winners believe, this was said by Nestle, because at the onset of the contest, the all new Nexus 7 (2013 release) were yet to be released in India by Google hence the words "the all new exclusive Nexus 7". BUT to the bewilderment of winners, we are being shipped now with the old stock NEXUS 7(2012) which is no more under production by the company Asus. These Nexus 7 tablets have a manufactured date of March 2013. All winners are expressing their discontentment regarding this grave issue continuously on KitKat facebook pages worldwide and other major blogs. Also we are trying to reach concerned officials at the top of this promo campaign but no representative, yet, seems to be keen in listening or bothering about our concern. The only response we got from Kitkat India facebook page on 7-NOV-2013 is quoted here:"We hear you are unhappy. Winners got the Nexus7 tabs available in India in Sept (contest date). The new version launched only in Nov." We like to contest this justification by Nestle by saying that "why then were images of the unreleased all new Nexus 7 (2013) shown on every promotional media if it was already pre-decided by the promoters in India, to gift the winners with the older release Nexus 7 (2012)?" There are evidences of images on Kitkat India facebook page, reading "THIS TABLET CAN BE YOURS" before the picture of the all new Nexus 7 (2013). We winners feel that we have been looked upon as lesser value contestants in relation to contestants of same contest in the USA or UK or Australia who participated in this worldwide known contest. Since in other countries like US/UK/AUS winners have already received/or are receiving the promised "all new Nexus 7(2013 release) tablets", we too have a right to get our deserving tangible gratification i.e Nexus 7 ("2013") tablet. Please note that the Nexus 7 (2013) released in India on 20-Nov-2013 along with the new Nexus 5 smartphone. Note that the Kitkat India contest closed on 22-Nov-2013. I request the Central Department of Consumer affairs to look into this grievance that is concerning almost a 1000 winners across India. Note that These gratification promises were offered through specially printed promo kitkat chocolates/wrappers with minimum MRP of INR10.
