Complaint Details
My name is Sagar Shinde and I reside in Ghatkopar West, Mumbai.
On 30th April 2013, I had undergone a cosmetic liposuction surgery at Vardan Nursing Home Pvt Ltd, Goregaon West. I came to know about this hospital through their website www.alluremedspa.in
During the pre-surgery consultation, the cosmetic surgeon, Dr. Milan Doshi had quoted me Rs. 60,000/- for the surgery excluding the Service Tax. The consulting fees were Rs. 1,000/- which would be reimbursed if I opted for the surgery. However, after the surgery, they asked me to pay double the amount as the surgery was complicated and took more time to perform. I had to pay the entire fees as they did not allow me to get discharged from the hospital.
I paid Rs. 1,05,000/- (Base Surgery Fees) + Rs. 12,978/- (Service Tax @ 12.36% on Rs. 1,05,000/-) = Rs. 1,17,978/- (Base Fees + Service Tax) and an additional Rs. 2,360/- (2% of Rs. 1,17,978/- as the mode of payment was credit card)
So, in all, I paid Rs. 1,20,338/- towards the hospital fees.
After the bill payment, it was discussed that the final bill will be sent to you by courier.
After repeated requests over the phone, they sent me a bill (Invoice No. May0004 Dated 2-May-2013) amounting to Rs. 61,106/- and the Service Tax was computed only on Rs. 51,100/- the details of which are as under –
Service Tax = Rs. 6,132/-
Education Cess = Rs. 122.64
Secondary and Higher Education Cess = Rs. 61.32
After I questioned them the authenticity of the bill, they agreed to send me a revised bill (Invoice No. May0004 Dated 2-May-2013) amounting to Rs. 1,20,338/- and the Service Tax was computed on Rs. 93,100/- the details of which are as under –
Service Tax = Rs. 11,172/-
Education Cess = Rs. 223.44
Secondary and Higher Education Cess = Rs. 111.72
I highly doubt the authenticity of the revised invoice and decided to discuss this issue with a Chartered Accountant. I believe that I have been duped to the tune of Rs. 60,000/-. The Chartered Accountant asked me to get a copy of his Service Tax for CENVAT credit purpose.
It has been several months since I have been repeatedly trying to get in touch with the Hospital Authorities for the above said documents but they have been avoiding me for reasons best known to them.
I would like to procure detailed information regarding the Service Tax paid by Vardan Nursing Home Pvt Ltd towards my Invoice No. May0004 Dated 2-May-2013. Also which one of the above two invoices is genuine as per the company’s records.
