Facts of the complaint:

Dr. Vivek Agarwal had booked a to and fro non refundable flight for his son Mr. Siddhant Vivek Agarwal from Chicago to New Delhi via London and Frankfurt scheduled to depart from Chicago on November 22, 2013 through Cleartrip services.
Cause of action:
Cleartrip did not intimate the complainant that transit visa shall be required in the travel either at the time or after the flight reservation were done. It was only when Mr. Siddhant Agarwal arrived at the check in counter of Chicago Airport that he was denied boarding on account of the transit visa being not available. Contrary to it was that Mr. Siddhant’s baggage was booked upto in India from the destination itself without checking his visa status. The customer care representative of the Cleartrip insisted on cancelling the to and fro ticket and instead procure a fresh reservation for the same route. Dr. Vivek S. Agarwal had no other option in such situation and had to cancel the entire non refundable ticket to and fro and make fresh reservation for the same route. Therefore, the monetary loss caused to the complaint due to the negligence and deficiency in service of the opposite party is Rs. 55, 413/-. In addition to this such situation caused tremendous stress to the complainant and his family.

Prayers
a. refund the entire amount that was forfeited by the opposite party on account of the cancellation of the onward ticket from Chicago to India;
b. pay a suitable sum towards punitive compensation for mental agony, inconvenience and hardship caused;
c. pay costs of this complaint and;
d. pass such further or other order as this Hon’ble Forum/Commission may deem fit and proper in the circumstances of the case and thus render justice.
