Complaint Details
Dear Sir/Madam,
I, Mr. Ganesh Balaji Chavan, am constrained to submit this formal complaint against Maruti Suzuki ARENA, Latur, regarding the gross negligence, false assurances, deficiency in service, and severe financial loss caused to me during the exchange of my vehicle.
I exchanged my Maruti Suzuki Ertiga VXI CNG (Registration No. MH14 JX1616) for a Maruti Suzuki Victoris VXI CNG (Registration No. MH55 B3928) through your authorized dealership, Maruti Suzuki ARENA, Latur.
At the time of finalizing the transaction, the exchange value of my Ertiga was mutually agreed at ₹8.95 lakh (including Exchange Bonus). Before proceeding, I clearly informed the dealership that my Ertiga was under an active HDFC Bank vehicle loan.
The dealership executive specifically assured me that after taking possession of my old vehicle and all required documents, the Demand Draft (DD) as per the HDFC Bank Foreclosure Letter would be prepared and deposited within three days, and my existing loan would be closed immediately.
Relying entirely upon this assurance, I handed over my old vehicle and all required documents to the dealership on 18 July 2026. On the same day, HDFC Bank disbursed the loan amount for my new vehicle through NEFT to the dealership.
Thereafter, on 21 July 2026, I took delivery of my new Maruti Suzuki Victoris. Before accepting delivery, I once again asked the dealership executive whether the Demand Draft had been deposited with HDFC Bank. I was clearly informed that the DD had already been deposited and the foreclosure process had been completed.
However, after verifying directly with HDFC Bank, I found that this information was incorrect. As on 25 July 2026, no Demand Draft had been deposited, and my previous vehicle loan remained active.
This clearly indicates that I was given false and misleading information, causing me to continue paying interest on a vehicle loan even after surrendering my vehicle.
Further, I wish to place on record that HDFC Bank had granted me a special one-time waiver of ₹15,000 towards foreclosure charges (Reference No. 112265185). Based on this approval, a Foreclosure Letter was issued, which was valid up to 25 July 2026.
Despite having my vehicle, documents, and foreclosure details since 18 July 2026, the dealership failed to deposit the Demand Draft within the validity period of the Foreclosure Letter.
As a direct result of your dealership's negligence:
My new vehicle loan of ₹12.10 lakh has already commenced.
My old vehicle loan of ₹6.46 lakh is still active.
I am paying interest on both loans simultaneously.
I have suffered avoidable financial loss.
I have been exposed to the risk of losing the ₹15,000 foreclosure waiver granted by HDFC Bank.
I have suffered unnecessary mental stress and inconvenience.
Another serious concern is that although I handed over my Ertiga on 18 July 2026, the dealership did not issue any written acknowledgment or vehicle receiving receipt. Taking possession of a customer's vehicle without providing an official receipt is highly irregular and unacceptable.
I am myself a banking professional, and I fully understand the importance of loan closure, financial compliance, and transparent documentation. It is extremely disappointing that a reputed automobile manufacturer and its authorised dealership have handled this transaction in such an irresponsible manner.
The dealership has failed to honour its commitments, failed to act within the agreed timeline, and provided incorrect information regarding the status of my loan foreclosure. This has completely eroded my confidence in the transaction.
Accordingly, I hereby demand the following:
Accept the return of my new Maruti Suzuki Victoris VXI CNG immediately.
Return my old Maruti Suzuki Ertiga VXI CNG (MH14 JX1616) in the same condition in which it was handed over.
Reverse the entire exchange transaction.
Refund the complete NEFT amount received from HDFC Bank to the respective loan account without delay.
Reimburse all additional interest, foreclosure-related losses, and any financial loss suffered by me.
If I lose the benefit of the ₹15,000 foreclosure waiver due to the dealership's delay, the dealership shall fully reimburse the same.
Compensate me for the mental harassment, inconvenience, and financial hardship caused.
Provide a written explanation regarding the false information communicated to me about the Demand Draft and loan closure.
I shall be visiting your dealership on Monday morning to return the newly purchased vehicle. I expect the entire transaction, including reversal of the exchange, return of my previous vehicle, refund of the loan amount, and settlement of all financial liabilities, to be completed on the same day.
If this matter is not resolved immediately, I shall initiate appropriate legal proceedings before the Consumer Commission and other competent authorities for recovery of my financial losses, compensation for mental harassment, litigation costs, and any other relief available under applicable law.
