We are a group of 40 ppl who have booked flats in project Kumar Shantiniketan by Kumar Builders in Pashan, Pune. Bookings were done between June 2009 to June 2010 period. 35 members agreement were registered by builder. 5 members' agreement were not inspite of paying the 15% of agreement value in required timeframe. In Nov 2011, builder changed project layout without consent of buyer and sent letters demanding increased rate (rs.600 per sq. ft. additional) that agreed rate at the time of the booking. The agreement value on average is 31 lakh and all the members have paid 15%,avg 4.95 lakh to the builder. We want file a complaint at national commission against builder and want to get the builder give the flat at old agreed rate, make hims withdraw rate esclation demand and provide possession in 2 yrs timeframe with compensation for delays cause so far. Based on the details, do you think this qualifies for National commission. As per our understanding, it does. Would like you to provide your expert opinion. Also, if we want to seek your services at National commission then what will be you fees approx. an estimate will be really helpful to make the fund arrangements.
