Complaint Details
Unnecessary extra charges put by the Supertech for Unit 1906 in Nicolas1 at Supertech Czar Suites, Plot No GH-02, Sector Omicron-1, Greater noida, 201308.
1. Supertech has charged us @ INR 187.26/sq. ft. for our unit while these charges were not there when we booked our unit. As per SUPERTECH, these are due to the increased charges from Greater Noida Authority. Clause No 16 of the allotment letter says that if any such incident occurs in present or future, then Supertech can charge. Nothing is mentioned regarding the events that have happened in past. This decision of Greater Noida Autority has come in November 2011 (Before our date of flat booking 25.01.2012). This clause should not be applicable to us.
2. Supertech has charged us for increased super area ( Old – 1070, New – 1120, Increase - 50 sqft ). We replied that as per allotment letter clause no 51, any alteration resulting in plus minus 5% of super area will not have any impact and Supertech can’t not charge for this increase. To our surprise they have today produced a drawing with area of 1125 sqft. Increasing 5 sqft area just to make increased area 5.14% and defend the clause. Their website shows 1120 sqft even today ( Screen shot enclosed ). When asked about the new drawings approved by the Government signing authorities, they don’t have any reply. IT CLEARLY SHOWS CHEATING.
3. Supertech has not adjusted the charges @ INR 5/sq. ft as per penalty clause for delay in possession for around 2 years. As per SUPERTECH, Delay in possession happened due to farmer’s agitation which effected the construction for 18 months and for the same period delay penalty will not be applicable on our account. We had asked to Supertech to please specify the time frame (from date to date) for which construction affected and also concrete proof of this. When asked about wheather it is written anywhere in Allottment letter, Supertech is not able to reply on this.
4. Supertech has charged us interest of delay in payment while I have booked my unit in down payment plan (DP) on 25.01.2012. I had to pay the balance amount within 30 Days of booking ie : On or before 27.02.2014. I have received the allotment letter dated 8th Feb 2012 vide courier on 12th Feb 2012 for signing. Can Supertech please explain me this delay of 16days from their end, which leaves me with only 15 days to get everything clarified from the bank.
5. SUPERTECH did not adjust the open car parking charges as per 2010 Supreme Court ruling. Ruling delivered by justice RM LODHA & AK PATNAIK bench of Supreme Court. How they can overlook the decision made by the Honourable Supreme Court of India.
6. Extra Meter Connection charges but these are not mentioned in the allotment letter & initial booking form.

Consequences of the illogical Demand Notice:
I had booked this house using all the hard earned money and had dreamt of my own House shortly. But this delay in possession for approx 2 years shattered all my dreams and has following impacts :
1. I kept on saving money for possession time from the last 2 years sacrificing all my luxuries.
2. I couldn’t go for a holiday because I had to save money for Possession time due to which a lot of internal conflicts have come up in the family.
3. I had to stay in the rented house for 2 years and also had to pay hefty rent for the past 2 years.
4. I am an ordinary middle class man who makes house once in a lifetime. If Supertech asks such big amounts, I may be left with no options but to take Personal loans or loans from friends. Repaying these loans is not easy when you have a family to support. I am the only bread earner of my family. Please help me.
5. I am very much willing to pay to Supertech the justified amount which I have kept aside from a very long time, and shift to MY DREAM HOME. You can see my ICICI & Punjab National Bank statement ( Enclosed )
All the above mentioned things are giving us immense mental harassment and financial problems. We are paying hefty interest to the bank loan and the delay in Possession forced us to stay more 2 yrs in rented house and we are paying hefty rent also. Mental, Financial, Social problems have come up because of this Demand Notice by Supertech Limited.
What we want :
We want our Dream Home by paying the justifiable amount. We have enclosed an excel sheet which shows Supertech Demand Vs Actual Due.
We want CORE CENTRE to intervene and help us by getting the justice done to us. This will set up an Example in future for such BUILDERS.
