I have been charged a VAT on my Flat in Evershine Cosmic at 1% of the agreement value by the Builder totalling approx Rs 1,22,585/=. My question is how has VAT been determined at 1% of the Agreement Value ? when the builder has already paid VAT on various products & services. Secondly, why am I liable to pay this tax. It is the builder who should pay, and the amount on which it should be levied should be the residual cost of the flat after deducting all the previous VAT paid by the builder. Thirdly the builder is demanding Interest on the VAT amount from Dec 2011 till date. Why should I pay interest, when I was not advised of this in Dec 2011. I was only informed about VAT in Aug 2012 by the builder. I would request your clarification regarding computation of 1% as VAT, and my liability to pay interest to the builder.
