Dear Sirs,
Our builder EKTA WORLD (EKTA DEVELOPMENT) has been demanding VAT at 5% on Agreement Value and for that he has sent letter to all the flat owners. He have been asking for VAT at the flat rate of 5 % on Agreement Value. We have requested them for systematic calculation as per MAHAVAT article and other articles in newspapers ( The TIMES OF INDIA & DNA) Vat should not be between 0.5% to 1.5 %. As Builder had taken cheques during possession in 2009 has started depositing in the bank which is based on 5% formula which is unfair on Flat owners.
As per all the articles it should be between 0.5 % to 1 % but Builder is taking undue advantage as he had taken as cheque from flat owners in 2009 during possession.
NOTE : WE ARE ASKING HIM TO REFER MS SWATI KALE ( DEPUTY COMMISSIONER, SALES TAX DEPARTMENT IN DNA NEWSPAPER) but he is asking for 5% VAT AMOUNT.
We are herewith attaching newspaper cutting of DNA AND THE TIMES OF INDIA. In DNA there is article by Ms SWATI KALE( DEPUTY COMMISSIONER, SALES TAX wherein she informs flat owners that developers should levy tax on CONSTRUCTION COST and allowed deveopers to levy it on agreement amount. Howeverm VAT is charged on the amount which is the lowest. But developer is charging flat 5% on agreement value.
Please intervene and help us from harassment of builder.
