Complaint Details
Dear Sir, We had purchased an underconstruction 4BHK flat at Oberoi Esquire on Feb 2011 for a total consideration of INR 4,05,00,000. The carpet area promised was 1751 sq ft, the usable area (includes balconies and dry areas)promised was 2361 sq ft. and the Super Built up area was 3230 sq ft. However, in march 2012, the builder sent us a letter stating due to recent Development Control Regulation changes, they have to remove balconies and change the layout and reduce the usable area to 1956 sq ft. They did not reduce the super built up area on which we flat buyers have to purchase. This is highly unethical as new DC regulations do not state the builder cannot give balconies, instead it mentions builders can purchase 35 percent fungible FSI by paying 60 percent of ready reckoner rates. We are being duped by the builder as he is passing on the cost to us by reducing our usable area of the flat. Please help!
