Nature of complaint against M/s Sigma Manpower Services
M/s Indico Marine Pvt Ltd had entered into agreement with M/s Sigma Manpower Services on 05 May 2011 for providing manpower to Indico on payment of membership fee of Rs 4412/- (Four thousand four hundred twelve only) including service charges valid for a period of three years. The amount was paid by Indico vide IDBI Bank cheque No. 453340 dated 05 May 2011. M/s sigma vide their letter dated 29/04/2011 (which formed the part of agreement as additional terms and condition of agreement) had agreed to M/s Indico in writing “if the selected candidate resigns from your office or you terminate the candidate, we shall provide candidate within 2 days. If the candidate is not forwarded within 7 days, your money will be refunded”.
M/s Indico requested M/s Sigma to provide office boy wef 06 may 2011 but M/s Sigma failed to provide the office boy and refused to return the amount charged despite numerous calls. Moreover M/s Sigma did not bother to respond after taking the amount. In this regard the e-mail correspondence is a proof. It shows the intention/motive of the M/s Sigma was to cheat M/s Indico by way of their fraudulent act.
After giving sufficient time, M/s Indico sent two Demand Notices to M/s Sigma for the refund of the amount of Rs 4612/- vide their letter No. Indico/Sigma/01/2012 dated 31/01/2012 and 15/02/2012 by a registered A/D. But M/s Sigma did not respond at all and honour their commitment.
M/s Indico also approached CBD Police Station for registration of FIR against M/s Sigma vide letter No. Indico/Sigma/01/2011 dated 12/12/2011 and Indico/Sigma/01/2012 dated 27/04/12. However, the police did not call their owner to police station and advised M/s Indico to take recourse to Consumer Court.
