Complaint Details
I bought my Flat on 21st June 2008 (Agreement Date)in Yellow Blossom after paying the full consideration value as per schedule of payment given by the Builder. The builder did not inform or notify me either verbally or in writing at the time of purchase about any impending payment of MVAT. The Demand letters that I received from the builder for the different instalments also never mentioned about any impending payment of MVAT. After making the full payment of the Flat including charges for MSEB, Solar, etc, I was given possession of the Flat. Even at this time I was not informed about any impending payment of MVAT. The builder has now sent me a letter demanding for MVAT payment on the agreement value of my Flat @ 5% of the Agreement Value. The demand from the builder is based on Clause 2 in the agreement, which states as follows " The said price however, does not include the cost and other charges for the restricted areas and facilities, MSEDCL meter deposit, society/apartment formation charges, legal expenses, maintenance deposits, taxes and charges etc. as may be levied from time to time by the concerned authorities, which shall be paid by the Purchaser/s separately as and when the same will be due or payable under this Agreement. I firmly believe this is an unjust unfair business practice by the builder. I would request your expert advise in the matter to know if the demand made by the builder for MVAT based on the general clause in the agreement justified and legally binding on me.
