Complaint Details
I have taken internet connection from Tikona Digital Networks under their plan ADULH750K on 14 April 2012. Under this plan Tikona Digital Netowrks agreed to provide me internet services at 750 kbps for next six months without any data limit. My User ID is 1106226841 (Attachment 1)
During the period of 6 months I have filed numerous complains for reduced speed on which they replied that my speed is downgraded as my data limit is exceed about I have not informed when I was taken this connection.
On 10th Oct 2012, I have sent a mail to Tikona asking them to terminate my connection as my work was regularly getting affected due to variable internet speed. Now as I have taken connection on 14th April my six months is till 14th Oct and on 10th Oct I have asked them to terminate my connection. Despite of this they have sent me bill of Rs 4067.93 asking me to pay as my plan is automatically renewed (Attachment 2). Then after regular follow up and my numerous calls to them they have send me a revised bill of Rs. 267.43 dated 07th Jan 2013, which according me shouldn’t be there as I have terminated my connection prior to due date. (Attachment 3)
On 31st Jan 2013, I got a call from number 8687983734 informing that he is a lawyer and calling from Delhi and Tikona Digital Networks has asked him to file a case against me for non-payment of bill in Delhi Court. He said outstanding amount is Rs. 4067 and I have to come to Delhi court for hearing of my case once my case is filed. He has given me an hour to contact Tikona Digital Networks and pay the amount or else I would have to come to Delhi and pay huge penalties.
I am working in Mumbai and after hearing this I was concerned as it would be very difficult for me to go to Delhi for hearing.
Now please look into following issues
1. Please find below the legal notice which is their on Tikona Digital Networks Website
“These terms and conditions are governed by and to be interpreted in accordance with laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the web site whether in contract or tort or otherwise, to submit to the jurisdiction of the courts located at Mumbai, India for the resolution of all such disputes.”

It clearly says that in case of any legal proceedings, jurisdiction will be of the courts located in Mumbai. Than how can they file the case in Delhi court?
2. When they have sent me a revised bill of Rs 267 how my outstanding amount is still Rs 4067?
3. On looking on internet I found out that number from which I got this call i.e. 8687983734 is registered to Tikona Digital Networks itself.
4. The way that person blackmailed me and said I have to come to Delhi court if I don’t pay Rs 4067 in next one hour.
