Complaint Details
Dear Sir/Ma’am,
This Complaint is in regards to Flat booked in Amrapali Hanging Garden, Sec-107,Noida. Following are the Grievances which need to be addressed.
1) Amrapali Group has launched the Project with the name of Amrapali Hanging Garden in Oct 2011 without having appropriate approvals from Govt Authorities and taken the 10% amount on booking.
2) The Builder has asked another 10% in the month of August 2012 against signing of FBA failing to which a interest of 18% was levied upon buyers.
3) Most of the Buyers have signed the FBA which was totally one sided in favor of Builder in fear of 18% penalty.
4) After 1 year when Buyers started enquiring about project status of approvals like Environmental Clearance and Layout approvals, then they started saying that this project is Joint Venture between 5 Partners speak to one director who has major share in this project.
5) Buyers have trusted on the Brand name of Amrapali how can Amrapali sell their Brand to any X,Y and Z.
6) With the recent developments and notice published by Amrapali dated 21.01.2013 in TOI page number 17 against one director have increased our mental agonies in manifolds.
7) Its already 1.5 years since we have invested our hard earned money with this builder but till date there is no clarity and start of work at project site.
8)The site office has been locked all employees are shifted in Sector 63, Corporate Office of Amrapali.
9) Now the rates in Sector 107 has raised tremendously and we are in no position to book anywhere else.
Please look into this issue as nearly 700 people along with me are stuck and suffering over last one year

Reply: The Complaint against Amrapali group was placed before our legal cell and their comments are as follows -

"This will be a fit case to take up under the Consumer Protection Act, 1986, against the builder, demanding execution of the agreement as well as seeking possession of the flat when the bukilding is ready, on the same agreed rate/consideration. The Right to Information Act, 2005 can be put to good use for seeking details about the layout plans and the details of application filed with the concerned authorities by the builder for the proposed construction and also for what is the reason for the delay in granting aproval, by the said authorities. On the basis of the information that may be received, the complainant can decide to ask for refund instad, with the compensation and interest and cost."
