Complaint Details
mrapali Hanging Gardens (“AHG”) was launched and put up for bookings in October, 2011. I booked flat in the month of February, 2012 and made a payment of Rs. 6,06,000/-. As promised, the excavation did not start in the month of March, 2013. On inquiry, I was assured that excavation will start very shortly. Without getting proper approvals and without any development in the construction front, the Builder Buyer Agreement was signed.

Till date, there has been status quo and no development has taken place. It’s more than a year from the date of booking and even the excavation has not started.

No one is available at site office. All the phone numbers given earlier are not functional any more. No response from anyone. I have made a total payment of Rs 6,06,000/- since February, 2012 and there has been no development in the project at all. Please help us as our hard earned money is on the risk.

Reply: Dear Mr. Rakhi Singh,

The Complaint against Amrapali group was placed before our legal cell and their comments are as follows -

"This will be a fit case to take up under the Consumer Protection Act, 1986, against the builder, demanding execution of the agreement as well as seeking possession of the flat when the bukilding is ready, on the same agreed rate/consideration. The Right to Information Act, 2005 can be put to good use for seeking details about the layout plans and the details of application filed with the concerned authorities by the builder for the proposed construction and also for what is the reason for the delay in granting aproval, by the said authorities. On the basis of the information that may be received, the complainant can decide to ask for refund instad, with the compensation and interest and cost."
