Complaint Details
I the undersigned Farid Khan bonafied member of the Oshiwara Sandipani Teachers CHS Ltd., having in occupation, use and possession of a residential flat no 2A/41 situated at the plot bearing CTS No 1/A (pt) in Oshiwara village of Oshiwara Sandipani Teachers CHS Ltd., New Link Road, Jogeshwari West, Mumbai 400 102.

It is not out of place to mention that above referred residential flat allocated by MHADA in the year 1994 for Teachers under LIG scheme. On 18-03-2008 the above referred society entered into the agreement for the redevelopment with M/S SHREEDHAM BUILDERS having its office at 105/106, Vijay Industrial Estate, 1st floor, New Link Road, Malad West, Mumbai – 400 064, Tel – 28755111.

In May 2010 our old building was demolished and construction of new building work has been started thereafter. Presently after a period of almost 32 months with effect from May 2010 the building work is still incomplete by more than 75% (Only 4 floors slabs are ready out of 15 floors to be constructed as per the approved BMC plan). Since last one year the construction work of our building has been halt and developer also stop paying monthly rental compensation cheques from last 4 months (Nov’12 - Feb’13).

However several critical clauses are ignored while development work was carried out. Most importantly building is not reconstructed as per agreed DCR rules in the agreement and developer changed it to get extra FSI benefit from MHADA without the knowledge/consent of Bonafide members. It appears that developer has done some fraudulent acts on behalf of our society with the help of some managing committee members.
