Complaint Details
I booked a flat at Green Acres, Malad in May 2011. The project has been launched by Nirman Realtors & Developers. At the time of booking, it was told that the construction of building would start within 2 months. However, even after two years, the builder has failed to obtain commencement certificate. Further, at the time of booking, the builder had agreed to finalise the booking after receiving 15% of the project cost (amounting to approx. Rs 11 lakh), which I immediately paid and was also issued a allotment letter. However, of late when there are some signs of the project being finally started, builder has begin to harass me saying that I have to pay 50% of the project cost before agreement, otherwise the deal would be cancelled. They have started sending demand letters to pay the whole amount within one week, failing which interest would be charged at 18% p.a. The demand being made by builder is in clear violation of the guidelines of Maharashtra Ownership of flats Act, 1963 which states that maximum amount that can be sought by a builder prior to entering into a formal agreement is 20% of the project cost. I am working as a Class I officer in a government organisation but the builder seems to have flouted all rules and regulations to satisfy his greed. Kindly suggest the remedies avilable to me in this matter.
