Complaint Details
I have bought a house “BPTP Villa” in second sale in BPTP Parkland, Sector -88, Faridabad and I am the first occupant of the house having occupied the house on 8th Feb 2015. The builder is BPTP, a Haryana based builder having offices in BPTP Crest, Plot No - 15, Udyog Vihar Phase – 4, Gurgaon, Haryana, India. I have three phase power supply in my house. On the night of 6th July 2015, one of the phase (Electricity Power) lost power. We lodged our complaint with BPTP through the following channels:
(1) Reported to Deepak Arora, the Estate Manager in Maintenance office located in Sector-88
(2) Telephonically at BPTP helpline centre and
(3) Through a written complaint to customer care centre.
Initially, the maintenance electrician could not locate the fault and blamed it to the internal house wiring. Subsequently, through my own resources, I found out that the fault was in the cable supplying power from the BPTP distribution board located approx 110 meters from my house. BPTP has made this as a centralized electricity energy meter installation board too, and our entire F2 block energy meters are installed in this board.
Deepak Arora, (Estate Manager, BPTP) on being informed about the defect, refused to attend to the problem citing it a house owner’s liability as BPTP has already handed over the house. According to him, BPTP’s liability starts before the meter and anything after the meter is owner’s liability. My contention is:
(1) How can the owner be liable for the cable laid outside his premises? I am liable for what happens inside the premises of the house. There are more issues relating to distance from the distribution board and installation and location of the meter as per the Central Electricity Regulation 2006 part III chapter iv & 2010, which again has been flouted by BPTP.
(2) Since BPTP maintains the peripheral infrastructure and we as house owners pay maintenance charges for infrastructure and the cable has been laid by BPTP, maintenance and replacement too should be BPTP’s responsibility.
(3) Since the cables are laid underground, there should be proper water evacuation system in the duct. As I opened the cover of the cable duct, I observed that the cables were waterlogged, thereby weakening the insulation of the cable thus causing the cable to short circuit which must have happened in my case or the cable is sub-standard.
I have further observed that the cables have not been laid properly as per the Central Electricity Authority Regulation 2010 norms. Whilst as per norms, the cables should be properly laid segregated and marked on the cable tray, I found the cables to be laid haphazardly, tangled and buried with lot of debris, waste and rubbish material and the cables were submerged in water as rain water had stagnated inside the duct. This is in contravention of the CEA norms and a very major safety hazard. Furthermore, the cable duct has become a breeding ground for reptiles, rats and dangerous snakes. Even in earlier instances the cables had punctured and short circuited, but BPTP had managed to arm twist the house owner in replacing the cable.
(4) Furthermore, BPTP has not followed the proper color coding scheme of RYBB (Red, Yellow, Blue, Black) for the wiring inside the house and the whole wiring needs to be rewired as per the IS 732:1989 and IS 4648:1968, but they have refused to do it.
(5) Furthermore, the property still comes under the defect liability clause and BPTP is liable to complete all the rectifications.
I request the concerned authorities to take punitive action against BPTP for failing to adhere to the norms of the regulatory authorities as they are flouting the norms and harassing the buyer’s with impunity.
