Complaint Details
I am Sandip R Ghume, currently residing at Thakur Village, Kandivali (East) has entered into transaction of booking of 2BHK flat in “Excellency Tower†on 11th floor of the upcoming project of Madhav Builders & Developers, 101, 1st floor, Dora Rose Building Opp., St. Francis School Ground, IC Colony, Borivali - West Mumbai - 400103
I have made payment of booking amount of RS. 25,00,000/- for above mentioned flat and received allotment letter dated 9th March 2013 from aforesaid firm stating allotment of Flat on 11th Floor (Area 1100 sq. ft. @ 7300/Sq. Ft.).The details of payment of Booking amount of Rs.25,00,000/- through cheques/ RTGS are as below :
Rs. 1,00,000/- Cheque No - 10004 Dated 24th Feb 2013
Rs.10,00,000/- Cheque No - 10005 Dated 10th March 2013
Rs.10,00,000/- RTGS Dated 25th April 2013
Rs. 4,00,000/- Cheque No - 10006 Dated 27th April 2013
However till date there is no progress in the projects. At the time of booking Madhav Builders & Developers presented that all approvals are in place and project will start in three months time. Unfortunately there is no further development in the project since the last two and half year.
I have not received any response from builder against my continuous follow ups regarding latest updates and utilization of funds collected on account of booking of flats.
It has been subsequently observed that builder commence sale of units in pre-launch booking before obtaining mandatory approvals for the project and at that time even before acquisition of the land which is against Maharashtra Ownership Flats Act and proposed The Real Estate (Regulation And Development) Bill, 2013.
The booking amount collected by builder is without prior government approvals and by giving false representation that required approvals are granted to him and before land acquisitions through SRA approval process amounts to misleading and fraudulent practices as per the said act.
Builder is showing casual approach and not updating current status as well as their future planning with regards to the project and also not refunding my money as requested by me in March 2014.
As builder is not working on this project and also not interested in releasing my booking amount of Rs. 25 Lacs along with finance cost to me reflect his fraudulent intention.
I am middle class family person made life time investment for dream home which is under risk. Therefore herewith requesting you kindly help me to get back my hard earned money. Details of builder and project are enclosed along with letter.
